The Supreme Court (Înalta Curte de Casaţie şi Justiţie, Civil Section I) rejected the appeal filed by the claimant (acting in person and as representative of another claimant) against the decision of the Alba Iulia Court of Appeal, thereby upholding the appellate court's ruling to decline jurisdiction and transfer the case to the Sibiu Tribunal. The underlying dispute was a patrimonial claim valued at 46,523,766 lei, brought against a company and the local municipality, with the question being which court had appellate jurisdiction over the first-instance judgment. The Court applied Articles 2(3) and 282¹ of the Romanian Code of Civil Procedure, holding that judgments in first-instance cases involving monetary claims not exceeding 1 billion lei are not subject to appeal but are directly appealable to the Tribunal as the appellate court; thus, the Sibiu Tribunal was the proper forum. The decision was final and irrevocable.

Invoked by the appellant as one of the grounds for the appeal, though ultimately not used to allow the appeal.

Art. 304 pct. 9 C. proc. civ.

Împotriva deciziei civile mai sus menționată a declarat recurs I.V.N.

DECIDE:

Respinge recursul declarat de I.V.N.
