Shareholders' appeal annulled for filing grounds with High Court instead of lower court.
Legislator summary
AI generatedThe High Court of Cassation and Justice (Second Civil Section) annulled the appeal filed by the shareholders of a limited liability company against the Bucharest Court of Appeal’s commercial decision of 10 June 2004, which had rejected their motion to set aside an earlier ruling. The appellants had filed their statement of grounds directly with the High Court rather than with the lower court whose decision was challenged, in violation of Article 302 of the Code of Civil Procedure, which requires appeals to be lodged with the court that issued the contested judgment under penalty of nullity. Consequently, the appeal was declared null and void, and the lower court’s decision remained in force.
