The Supreme Court of Cassation and Justice resolved a negative conflict of jurisdiction, definitively assigning competence to the Galați Court of Appeal to hear the appeal, thereby allowing the defendants to proceed with their challenge against the first-instance judgment. The dispute involved a property claim regarding a 131 m² plot of land, where the first-instance court ruled in favor of the plaintiffs, but subsequent procedural disagreements arose over whether the appeal should be handled by the Court of Appeal or the Court of First Instance due to the value threshold and the nature of the action. Relying on the amendments introduced by Law No. 219/2005 and Article 2821 of the Code of Civil Procedure, the Court held that for any challenge to a first-instance judgment from a District Court, regardless of whether it is technically qualified as an appeal or a cassation appeal, the material competence exclusively belongs to the Court of Appeal, not the Court of First Instance, which had previously incorrectly referred the case.

DECIDE:

Irevocabilă.
