Appeal against municipal order declared null for late substantiation
Legislator summary
AI generatedThe Supreme Court of Cassation and Justice declared the cassation appeal null, leaving in force the first-instance decision of the Municipal Mayor of Slatina and the subsequent appellate judgments that upheld it. The dispute concerned a challenge to an administrative order issued under Law no. 10/2001, where the appellant filed the appeal within the statutory deadline but submitted the substantiation of the appeal on May 20, 2004, significantly after the decision's communication on January 29, 2004. Relying on Article 303 and Article 306 of the Code of Civil Procedure, the court determined that the substantiation was filed after the fifteen-day legal deadline and that no public order nullities were present that could be raised out of time, resulting in the procedural nullity of the appeal.
