The High Court of Cassation and Justice declined its own jurisdiction and referred the appeal to the Court of Appeal Craiova, ruling that the appellate court—not the High Court—must hear the case. The dispute arose from an appeal filed against Civil Decision No. 320 of 2 March 2004 of the Court of Appeal Craiova. The decisive legal basis was Article 3 point 21 of the Code of Civil Procedure, as amended by Government Emergency Ordinance No. 65 of 9 September 2004, approved with modifications by Law No. 493 of 10 November 2004, which reassigned jurisdiction over such appeals to the courts of appeal; under Article II paragraph (3) of that law, the High Court accordingly declined jurisdiction in favor of the lower appellate court. The decision was final and irrevocable.

Din examinarea lucrărilor din dosar, constată următoarele:

Recursul de față a fost declarat împotriva deciziei civile nr. 320 din 2 martie 2004, pronunțată de Curtea de Apel Craiova.

II alin. (3) din lege,
