The Supreme Court of Appeals and Justice admitted the appeal, quashed the appellate court’s decision, and remanded the case to the Bihor Court of First Instance for further proceedings, effectively allowing the claimant to challenge the timeliness exception. The dispute arose from the claimant’s failure to contest a decision by the County Pension House, issued pursuant to a 1999 Government Ordinance, within the statutory deadline, resulting in the appellate court dismissing the action as late; the claimant argued that advanced age and illness prevented timely filing. The Supreme Court held that the appellate court failed in its active role to ascertain the truth under civil procedure law, ruling that the appeal was admissible because the claimant had not yet been given the opportunity to prove she was prevented from acting by circumstances beyond her control, citing Article 129 of the Civil Procedure Code regarding the court’s duty and Article 103 regarding waiver of appeal rights in cases of impediment.

C U R T E A

Asupra recursului de față;
