The Supreme Court of Cassation and Justice dismissed the appellant's appeal as unfounded, thereby upholding the lower courts' rejection of his request for the revision of his criminal sentence and obliging him to pay state judicial costs. The dispute arose from the prisoner's petition to revise a final conviction for drug trafficking (under Article 2 of Law No. 143/2000) based on two grounds: the application of a mitigation provision (Article 16 of Law No. 143/2000) due to his denunciation of another trafficker, and a request for individualized reduction of the penalty due to the need to support four orphans. The court ruled that the grounds invoked did not fit within the exhaustive statutory list of situations permitting revision under Article 394 of the Code of Criminal Procedure, which strictly limits admissibility to specific error conditions, thereby preventing the court from reassessing mitigating circumstances or applying specific statutory benefits via a revision petition.

394 C. proc. pen.
