The High Court of Cassation and Justice declared the appeal inadmissible and ordered the case to be remanded to the Bucharest Court of Appeal as the competent jurisdiction, leaving the appellate judgment of March 15, 2004, in force pending further review. The dispute concerned a civil action for eviction initiated in January 2003, where the defendants challenged the appellate court's decision that had reformed the first-instance judgment. The operative outcome was driven exclusively by procedural competency rules rather than the merits of the eviction claim, as the High Court determined that the newly enacted legislation mandated the lower appellate court to hear the appeal. The decision relied on Article II, paragraph (3) of Law No. 219/2005, which transferred jurisdiction for appeals under review to the Court of Appeal, thereby compelling the Supreme Court to decline its own competence and transfer the file back to the competent instance.
