The High Court of Cassation and Justice declined to rule on the merits and ordered the case transferred to the Constanța Court of Appeal for competent adjudication, thereby leaving the prior judgments (trial court dismissal and appellate rejection of the plaintiff's claim) intact pending the new review. The dispute involved a plaintiff's action against private parties and a state agency, which had been dismissed for lack of active procedural standing at first instance and on appeal; the plaintiff then filed a recourse challenging the appellate decision. Legally, the Court applied Article II paragraph (3) of Law No. 219/2005, read with Article 2 point 2 of the Civil Procedure Code as amended, determining that under the new jurisdictional rules the recourse fell within the appellate court's competence, not its own, and thus remitted the case accordingly.
