The Supreme Court of Cassation and Justice issued an irrevocable order declining jurisdiction (declinare de competență) and referred the case back to the Bacău Court of Appeal, thereby leaving the original appellate decision in force pending further action by the competent court. The dispute concerned a challenge to the termination of co-ownership (ieșire din indiviziune) through an appeal against a first-instance civil decision, specifically raising a jurisdictional issue regarding which court was authorized to hear the recourse. Relying on Article 3, point 21 of the Civil Procedure Code as modified by Urgent Government Ordinance No. 65/2004 and approved by Law No. 493/2004, the court determined that the appeal fell within the exclusive competence of the Court of Appeal and applied Article II(3) of Law No. 493/2004 to mandate the transfer of the file to the Bacău Court of Appeal.
