The High Court of Cassation and Justice admitted the defendant's cassation appeal, quashed the appellate decision, and remanded the case to the same appellate court for re-judgment, effectively reinstating the issue for substantive review. The dispute involved a civil action for eviction filed by a plaintiff company against a tenant occupying a dormitory room without title, which was initially granted by the first instance but later dismissed by the appellate court solely on the procedural ground that the defendant's appeal was not motivated in fact and law. The Supreme Court found that under Article 292(2) of the Code of Civil Procedure, when an appeal is unmotivated, the appellate court must decide on the merits based on the grounds presented at first instance, rather than rejecting the appeal for lack of motivation; consequently, the appellate court erred by failing to address the substantive argument regarding the plaintiff's lack of valid title of property. The remand allows the appellate court to correct its error within the limits of its jurisdiction as a devolutive appellate body.

292 alin. (2) C. proc. civ.
