The High Court of Cassation and Justice dismissed the appeal as having lost its object, leaving the Court of Appeal’s decision suspending the execution of the underlying judgment in force pending the resolution of a separate appeal. The dispute involved a procedural challenge to a president’s order that suspended the enforcement of a first-instance civil judgment, where the appellant argued the appeal was null and void because the parties were not summoned, and asserted the original request was an attempt to delay the execution of favorable rulings. Noting that the counterparty’s appeal against the original first-instance judgment had been rejected by a subsequent decision of the Court of Appeal, rendering the suspended execution immediately enforceable and the procedural issue moot, the supreme court applied Article 312 of the Civil Procedure Code to dismiss the appeal due to the loss of its subject matter.
