Recourse to jurisdictional regulator: nullity for lack of motivation in appeal against inadmissible cancellation challenge
Legislator summary
AI generatedThe High Court of Cassation and Justice ruled that the appeal declared by the claimant was null and void, thereby upholding the lower court's decision that had previously dismissed the claimant's cancellation challenge as inadmissible. The dispute concerned a "regulator of jurisdiction" proceeding, where the Court of Appeal had found the initial cancellation challenge procedurally deficient because the underlying judgment had been issued by a court designated to resolve the jurisdictional conflict on the merits rather than as an appellate instance. Relying on Article 306(1) of the Code of Civil Procedure, the court determined the appeal was null due to the claimant's failure to provide mandatory legal arguments within the statutory deadline, and noting the absence of public order grounds to intervene ex officio, the court issued an irrevocable decree of nullity.

Asupra recursului de față;
