The Supreme Court (Înalta Curte de Casaţie şi Justiţie) admitted the claimant's appeal, quashed the appellate decision (no. 320 of 23 February 2004, Court of Appeal Suceava) and remanded the case to that same court for a retrial of the appeal, thereby leaving in force the trial court's initial judgment in favor of the claimant, which had found that the claimant's deceased predecessor had acquired ownership of land by usucapio (adverse possession) and of buildings by construction, and ordered registration of the inheritance-derived title in the land register. The dispute concerned an action against a commune (local administrative unit) for recognition of ownership rights over land and buildings; the appellate court had dismissed the action for lack of passive procedural standing of the defendant, but did so without putting that exception to the parties for debate. The Court held that the appellate court thereby violated the principles of party contradictoriality and the right to defense, and, under art. 313 of the Romanian Code of Civil Procedure (C. proc. civ.), remanded the case for the appellate court to re-examine the appeal, including the claimant's first grievance (the standing issue).

Asupra recursului de față;
