The High Court of Cassation and Justice admitted the appeal, set aside the appellate decision, and remanded the case to the Court of Appeal for a new hearing, resulting in a procedural victory for the property company. The dispute arose from the company's failed attempt to register ownership of an immovable in Bucharest; while the first-instance court rejected the request due to the missing postal code certificate, the Court of Appeal dismissed the subsequent appeal as untimely on the procedural ground that the judicial stamp tax of 34,000 lei was not paid. The Supreme Court found the appeal to be well-founded because documentary evidence confirmed the tax was paid on June 24, 2004, and the appeal petition filed that same day referenced the payment, with no court record indicating the receipt of the proof. Applying Articles 304(10) and 312(1) and (3) of the Code of Civil Procedure, the court determined that the failure to validate the tax payment was a procedural error, thereby ordering the cancellation of the dismissal for lack of fee and the re-adjudication of the appeal.

Asupra recursului de față;

- din înscrisul anexat recursului rezultă că recurenta a plătit la 24 iunie 2004 suma de 34.000 lei, cu titlu de taxă judiciară de timbru;

- tot la 24 iunie 2004, recurenta a depus la prima instanță cererea de apel, în finalul căreia menționa îndeplinirea obligației referitoare la timbrul judiciar, taxa judiciară de timbru, precum și anexarea chitanței doveditoare a plății ultimei taxe;
