Jurisdictional declination for minor visiting schedule appeal due to statutory transfer of competence
Legislator summary
AI generatedThe High Court of Cassation and Justice declared itself incompetent to hear the civil appeal and referred the case back to the Court of Appeal Constanța via declination of jurisdiction. The dispute involved an appeal filed by a defendant against a civil decision regarding the establishment of a visiting schedule for a minor. The Court determined that the appeal was inadmissible for it because the subject matter fell under the competence of the lower appellate court, as the initial decision was rendered before the entry into force of the normative modifications that would have allowed the High Court to assume jurisdiction. The operative legal basis was Article II(3) of Law No. 493/2004, which governs the transfer of pending cases to the competent jurisdiction following legislative changes.
