The High Court of Cassation and Justice dismissed the appeal on the merits, removing the case from its docket and remanding it to the Bucharest Court of Appeal for competent resolution pursuant to transitional provisions in Law No. 195/2004, thereby leaving the prior appellate decision rejecting the claim in force pending the lower court's re-examination. The dispute involved a civil action seeking a judicial judgment to serve as an authentic deed of sale for a 1,500 square meter land plot in Bucharest, which was initially rejected by the first-instance court and subsequently upheld by the Bucharest Tribunal on the ground that res judicata applied due to a prior 1991 judgment. The decisive legal basis was Article II(2) and (3) of Law No. 195/2004, which mandated the transfer of cases appealed against decisions rendered before the law’s entry into force back to the courts of appeal to ensure proper jurisdictional hierarchy and procedural compliance.

Asupra recursului de față;

Din examinarea lucrărilor dosarului, constată următoarele:

La data de 18 iulie 2001, I.I.
