The High Court of Cassation and Justice dismissed the defendant's appeal as unfounded, thereby rendering the lower court decisions irrevocable and upholding the final order compelling the defendant society to conclude a sale-purchase contract with the plaintiff for the apartment at the statutory price. The dispute concerned the plaintiff's action for specific performance to compel the defendant to sell a housing unit that was constructed by the economic entity prior to the enactment of the relevant legislation and for which the plaintiff held a tenant status; the defendant had argued that a board resolution refusing to sell should prevent the enforcement of the statutory right. Relying on Article 7 of Law No. 85/1992, the court established that the cumulative conditions for the forced sale were met, ruling that an internal administrative decision by the company's board of directors cannot override or prejudice the mandatory provisions of the law, and applying Article 312(1) of the Civil Procedure Code to reject the appeal.

312 alin. (1) teza a II-a C. proc. civ.

PENTRU ACESTE MOTIVE

Pronunțată în ședință publică, astăzi 13 mai 2005.
