The High Court of Cassation and Justice dismissed as inadmissible the referral for a preliminary ruling submitted by the Alba Tribunal, thereby leaving the lower court to resolve the case without a definitive supreme court interpretation. The dispute concerned whether a 20% penitentiary allowance, established under the salary framework law and a specific ministry order, constitutes a permanent bonus to be included in the calculation of rest leave indemnity during a period of delegation for judges and prosecutors. The procedural ruling was based on Article 521(3) of the Civil Procedure Code, which governs the admissibility conditions for such constitutional-level legal referrals, resulting in no substantive change to the status of the underlying litigation.
