The High Court of Cassation and Justice dismissed as inadmissible a reference for a preliminary ruling submitted by the Craiova Court of Appeal, leaving the procedural posture of the underlying administrative case unchanged. The dispute concerned whether the Government Decision approving methodological norms for public sector salary standardization remained legally effective after the entry into force of the comprehensive public salary framework law, a question submitted to resolve a conflict regarding the application of specific fiscal and budgetary measures versus the new statutory salary regime. The court’s decision relied on the procedural admissibility requirements for preliminary references under the Civil Procedure Code, specifically rejecting the request without examining the substantive issue of the legislative hierarchy or abrogation of the earlier executive order.
