The High Court of Cassation and Justice dismissed as inadmissible the referral for preliminary ruling submitted by the Buzău Court of Appeal. The dispute concerned the constitutionality of an internal administrative procedure regulating the compensation of overtime hours and the calculation of annual leave, specifically whether mandatory rest periods could overlap and whether leave duration could be adjusted without proportional reduction during leave periods. The core legal issue involved the interpretation and application of Articles 41 and 53 of the Romanian Constitution, regarding the fundamental rights to rest and annual leave, in the context of statutory labor protections.
