The High Court of Cassation and Justice, through its Full Bench for Resolving Questions of Law, issued a mandatory binding decision establishing that initiating criminal proceedings via a plea of guilty admission does not equate to an indictment, thereby denying the plaintiff-civil servant's implicit challenge and clarifying that this specific procedural step does not trigger the automatic suspension of service relations. The dispute concerned whether a public employee’s service suspension mandated by law upon criminal prosecution was erroneously applied based solely on the filing of a guilty plea agreement rather than a formal indictment. The decisive legal basis is Article 513(1)(l) of the Public Administration Code (Emergency Ordinance No. 57/2019), interpreted in light of the procedural distinctions between an indictment and other pre-trial filings, pursuant to the mandatory effect of pre-constituted decisions under Article 521(3) of the Code of Civil Procedure.
