The High Court of Cassation and Justice dismissed the appellant’s appeal, rendering the decision final and upholding the lower court’s order for eviction; it ordered the appellant to pay 7,000,000 lei in litigation costs to the co-owners. The dispute concerned a civil claim for eviction and the removal of movable property from an immovable property owned by the claimants, against which the occupant filed a counterclaim for compensation for improvements, arguing he held no domicile at the property and was awaiting a partition judgment to remove his belongings. The Court held that the appeal was unfounded because the appellant failed to concretely demonstrate illegality, error in the application of law, or incorrect interpretation under Article 304 of the Civil Procedure Code, affirming that the lower courts correctly found the appellant had no legal title to occupy the property.

Asupra recursului civil de față;

Din examinarea lucrărilor din dosar, constată următoarele:

Reclamantele T.C.E.

Împotriva acestei hotărâri a declarat recurs pârâtul.

IN NUMELE LEGII

DECIDE:
