The High Court of Cassation and Justice dismissed the appellant's appeal as unfounded, thereby upholding the Court of Appeal's decision to reduce the attorney's fees to 5,000,000 lei and leaving the initial district court judgment in effect, which had dismissed the plaintiff's claim for property ownership. The dispute arose from a property case involving a 1,177 sq. m. plot of land, where the losing defendant challenged the appellate court's reduction of the opposing counsel's fee from 20,000,000 lei, arguing that such modification was prohibited under Law No. 51/1995 regarding the legal profession. The court held that the reduction was lawful pursuant to Article 274(3) of the Code of Civil Procedure, which grants judges the discretion to adjust attorney's fees if they are disproportionately high or low relative to the value of the subject matter or the work performed, rejecting the argument that statutory fee regulations preclude judicial discretion in this context.

Decizia nr. 2844 Dosar nr. 11497/2004
