Admissibility of preliminary ruling on salary classification under Annex VII of Framework Law No. 153/2017 for public healthcare administrative staff transferred to local authorities
Legislator summary
AI generatedThe High Court of Cassation and Justice dismissed as inadmissible the request for a preliminary ruling filed by the Hunedoara Court of Appeal, leaving the lower court's position unchanged. The dispute concerned the applicable salary classification framework for technical, economic, and socio-administrative staff at public healthcare units whose management was transferred to local authorities, specifically whether their wages should be determined under Article 1 or Article 2 of Annex No. VII to Framework Law No. 153/2017, in the context of implementing Decision No. 61 of 17 October 2022. The decisive legal basis was the procedural inadmissibility of the referral, which prevented the court from addressing the substantive conflict between the two articles of the framework law regarding the remuneration of public healthcare administrative staff.
