The High Court of Cassation and Justice dismissed as inadmissible the connected preliminary reference petitions filed by the Craiova Court of Appeal, resulting in no change to the legal interpretation established by the earlier rulings. The dispute concerned whether public officials within the Ministry of Finance and its subordinated institutions were exempted from statutory allowances caps under Article XIV of Government Ordinance No. 9/2019, specifically challenging the interpretation that such officials were subject to these caps as determined by the Court’s decision on resolving legal questions of May 18, 2026. The decisive legal basis for the dismissal was Article 521(3) of the Code of Civil Procedure, which governs the admissibility of requests for preliminary rulings, thereby upholding the validity of the prior interpretative decisions regarding the scope of derogations for public sector remuneration.
