The High Court of Cassation and Justice admitted the referral from the Bacău Court of Appeal (Civil Section II, administrative and fiscal) and issued a preliminary ruling under Article 521(3) of the Civil Procedure Code, establishing that the term "military personnel" (militar) in Article 13(2)(a) of Law No. 295/2004 on the regime of weapons and ammunition does not include persons who completed mandatory military service and were subsequently transferred to the reserve. The decision, which is binding, resolves the interpretive question referred in the underlying administrative dispute (Case No. 1448/110/2024) and clarifies the scope of the statutory exception allowing firearm possession by military personnel, ruling that former conscripts in reserve status do not qualify. The court upheld the interpretation favoring a narrower reading of the exemption, with the referral prevailing and the ruling now binding for future application.
