The High Court of Cassation and Justice, through its Panel for Resolving Legal Questions, issued a mandatory ruling that clarified the remuneration rules for on-call medical staff, establishing that physicians available for emergency calls from home are paid a stipend equal to 40% of their hourly base salary rate for the on-call period without additional surcharges, while hours actually worked after being summoned to the facility are compensated according to standard duty rules. The case originated from a labor dispute regarding the interpretation of pay structures for public-sector medical personnel, specifically the distinction between on-call time and active service time under the framework law governing public salaries. The decisive legal basis is the interpretation of Articles 3(2), 3(3), and 3(6) of Chapter II of Annex No. II to Law No. 153/2017, which delimit the specific pay calculations for home-based emergency standby versus active on-site medical duties.
