The High Court of Cassation and Justice dismissed as inadmissible the referral from the Brașov Tribunal seeking a preliminary ruling on whether Article 37(1) of Emergency Ordinance No. 114/2018—freezing the monthly housing allowance for special-status prison staff at the December 2018 level for 2019–2021—also applies to the new housing allowance regulated by Article 111(2) of Law No. 145/2019 (up to 50% of net monthly salary, capped by actual rent), which came into force on 2 August 2019. The court did not rule on the merits; the referral was rejected under Article 521(3) of the Civil Procedure Code, leaving the underlying dispute unresolved and the prior applicable rules in force. The legal basis for dismissal was procedural inadmissibility of the preliminary reference, without addressing the substantive interpretation of the conflicting statutory provisions.
