The High Court of Cassation and Justice dismissed as inadmissible the reference for a preliminary ruling submitted by the Bucharest Court of Appeal, thereby denying the requesting court a binding jurisprudential resolution on the disputed legal issue. The case concerned an employment dispute involving the recalculation of public sector salaries under Framework Law No. 153/2017, specifically whether an undisputed salary entitlement could be challenged via a common law action for recalculation beyond the period in which it was originally granted. The decisive legal basis for the dismissal was the inadmissibility of the reference under Article 521(3) of the Code of Civil Procedure, which governs the requirements for submitting questions of law to the unified jurisdiction plenary, meaning the higher court did not rule on the substantive merits of the prescription or recalculation argument.
