Cumulative application of special sentence reduction grounds: exclusivity of statutory provisions for successive penalty diminishment
Legislator summary
AI generatedThe High Court of Cassation and Justice dismissed as inadmissible a preliminary reference request submitted by a Court of Appeal, thereby leaving the lower court's pending resolution of the substantive matter in force without the Court of Cassation's intervention. The dispute concerned a conflict of interpretation regarding whether special grounds for sentence reduction under distinct legislative provisions could be applied cumulatively to successively diminish a criminal penalty or if they were mutually exclusive, allowing only one reduction to apply to the same defendant. The court's decision was grounded in the procedural admissibility requirements of the Code of Criminal Procedure, specifically addressing the validity of the request for a preliminary ruling on a legal question arising from the interpretation of the Law on Special Measures for Social Reintegration and the Law on the Application of Probation, with the decision becoming mandatory upon publication in the Official Gazette.
