The High Court of Cassation and Justice dismissed as inadmissible the referral of a question of law submitted by the Timișoara Court of Appeal, thereby leaving the lower court's procedural path unaffected without resolving the substantive merits. The dispute concerned a labor and social security litigation regarding whether debts consisting of pension sums collected pursuant to judicial decisions that were subsequently annulled on appeal fell within the scope of debt relief provisions. The decisive legal issue involved the interpretation and application of Articles 1 and 2 of Law No. 125/2014 regarding debt relief, as amended by Law No. 285/2024, read in conjunction with the final provisions of that 2024 amendment, specifically focusing on the eligibility of such reversed debts for statutory scutirea de plată.
