The High Court of Cassation and Justice, in its Complete Bench for the Resolution of Legal Questions, dismissed as inadmissible the reference for clarifying a question of law submitted by the Oradea Court of Appeal. The dispute concerned the interpretation of Article 685(2) of Law No. 567/2004, specifically whether specialized auxiliary personnel of courts and prosecutor’s offices with 20–25 years of service are entitled to a service pension if they were already receiving a different public system pension (such as partial early retirement or disability pension) at the age of standard retirement. The decisive legal basis for the dismissal was Article 521(3) of the Civil Procedure Code, which governs the admissibility of references to the Complete Bench for resolving legal questions.
