Property Restitution: Necessity of Transfer from Public to Private State Domain for Possession When Location Assigned by Pre-Law 165/2013 Judgment
Legislator summary
AI generatedThe High Court of Cassation and Justice dismissed as inadmissible the preliminary reference submitted by the Maramureș County Court, leaving the lower court’s position without resolution from the supreme instance. The dispute concerned the interpretation of Romanian legislation on the restitution of property expropriated during the communist era, specifically whether the transfer of land from public to private state domain was a necessary prerequisite for putting a beneficiary into possession when the land constituted their former location and had been assigned by a judicial decision prior to the enactment of the governing law. The decisive legal basis involved the provisions of Article 13(1) and Article 6(5) of Law No. 165/2013 regarding the finalization of restitution measures, in conjunction with Article 24(4) of Law No. 1/2000 on the reconstitution of agricultural and forest land property rights, interpreted in light of the Constitutional Court Decision No. 395/2017.
