The High Court of Cassation and Justice admitted the referral from the Suceava Court of Appeal for a preliminary ruling and established that, in judicial review of decisions issued by county pension houses on pension recalculation requests, the court's examination is not limited to the grounds stated in the pension house's decision. This interpretation applies to Articles 153(g), 106(2), and 107(3) of Law No. 263/2010 on the unified public pension system. The ruling is binding pursuant to Article 521(3) of the Civil Procedure Code. The dispute concerned the scope of judicial review over pension recalculation decisions, with the court holding that courts may consider grounds beyond those expressly listed in the challenged administrative decision.
