Limitation period start date and compensation conditions for unused annual leave upon termination under the Labor Code.
Legislator summary
AI generatedThe High Court of Cassation and Justice, sitting as the Complete Bench for Resolving Legal Questions, admitted the referral and established binding legal interpretations regarding labor law, thereby providing the definitive answer to the legal issues raised by the Bucharest Court of Appeal. The dispute concerned the applicable statute of limitations and the conditions for claiming monetary compensation for unused paid annual leave upon termination of employment. The court ruled that under Article 268(1)(c) read with Article 146(2)-(3) of the Labor Code, the three-year limitation period for such pecuniary claims begins running only from the date of termination of the employment relationship. Furthermore, the court clarified that for leave periods exceeding the 18-month carryover limit, the right to monetary compensation subsists only if the employer failed to effectively offer the employee the possibility to take the leave; if the employee voluntarily refrained from taking the leave despite being offered the opportunity, the right to compensation does not exist.
