The High Court of Cassation and Justice dismissed as inadmissible the request for a preliminary ruling submitted by the Bacău Court of Appeal, thereby leaving the lower court's jurisdiction to determine the pending issues without new Supreme Court guidance. The dispute centered on two questions of criminal law classification: first, whether acts of threats and physical violence committed simultaneously against a single police officer constitute a single complex offense of outrage or a competition of offenses (outrage and battery); and second, whether similar acts of violence committed simultaneously against multiple police officers constitute a single outrage offense or a competition of offenses. The court's decision did not address the substantive legal questions regarding the application of the Penal Code’s provisions on outraging public officials (Art. 257), battery (Art. 193), or competition of offenses (Art. 38, 206), but rather resolved the procedural admissibility of the referral under Article 477(3) of the Code of Criminal Procedure.
