The High Court of Cassation and Justice dismissed as inadmissible the referral from the Pitești Court of Appeal seeking a preliminary ruling on whether the 500 lei monthly gross allowance under art. 31(1)(f) of Annex II, Chapter II of Law No. 153/2017 must be granted proportionally to actual time worked for radiology and imaging technicians, licensed clinical laboratory assistants, licensed balneophysiokinetherapy and recovery assistants, licensed dental assistants, licensed dental prophylaxis assistants, licensed nutrition and dietetics assistants, nurses, midwives, and assimilated staff, regardless of study level. The court refused to issue a preliminary ruling on this question of law, thereby leaving the referring court's pending dispute unresolved as to that issue. The case concerns statutory interpretation of public-sector salary legislation and the proportionality of a specific allowance to part-time or reduced working hours. The dismissal rests on procedural inadmissibility under the Code of Civil Procedure, with the ruling declared binding pursuant to Article 521(3) of that Code.
