The Supreme Court of Romania (High Court of Cassation and Justice) admitted a referral on a question of law, ruling that a creditor cannot claim statutory interest from the date of the court summons on conventional late-payment damages accrued prior to that date when the unpaid claim originates from a source other than a loan contract. The dispute concerned the interpretation of civil liability and procedural limits in administrative and labor disputes, specifically whether statutory interest compounds on existing conventional penalties. The decisive legal basis is the correlation of Article 1489(2), second sentence, of the Civil Code with Article 8 of Government Emergency Ordinance No. 13/2011, which collectively prohibit the cumulative calculation of statutory interest on pre-existing conventional late-payment damages in non-loan contexts.
