Classification of police disciplinary appeal decisions as administrative acts under Law No. 554/2004
Legislator summary
AI generatedThe High Court of Cassation and Justice, acting through the Full Panel for Recourse in the Public Interest, admitted the recourse filed by the appellate court leadership, establishing a binding, unitary interpretation of the law with mandatory effect under Art. 517(4) of the Civil Procedure Code. The legal issue concerned whether a reasoned decision by a hierarchical superior police officer rejecting a subordinate’s challenge to a disciplinary sanction constitutes an administrative act subject to judicial review. The Court ruled that such a decision, which upholds the initial sanction upon finding the appeal unfounded or late, qualifies as an administrative act within the meaning of Art. 2(1)(c) of Law No. 554/2004 (Administrative Litigation Act). Consequently, this decision prevails over any contradictory jurisprudence and mandates that such police disciplinary reviews be processed in administrative courts based on the statutory provisions of Law No. 360/2002 regarding the Police Status.
