Mandatory pre-litigation complaint to public institution head required before challenging property evaluation report
Legislator summary
AI generatedThe High Court of Cassation and Justice, acting as the body for resolving questions of law, admitted the referral from the Bacău Court of Appeal and issued a binding interpretation that a complaint filed with the head of a public institution during the evaluation procedure is a mandatory pre-litigation step before filing an action to annul an evaluation report. The dispute concerned the procedural prerequisites for challenging administrative property evaluations under the Administrative Code, specifically whether internal grievance mechanisms must be exhausted before judicial intervention. Relying on Article 20 of Annex 6 to Emergency Government Order No. 57/2019 (Administrative Code) in conjunction with Article 521(3) of the Civil Procedure Code, the court established that this internal appeal constitutes a compulsory prior procedure, thereby defining the admissibility requirements for subsequent civil litigation regarding public asset valuations.
