The High Court of Cassation and Justice admitted the referral for a preliminary ruling and held that, under Articles 850(1) and 863(1) of the Romanian Code of Civil Procedure, the debtor or any interested person may obtain the annulment of preventive or enforcement measures by consigning to the pursuing creditor the full value of the claim, including all accessories and enforcement costs, up to the date of the issuance of the adjudication act; in such a case, the bailiff must refuse to issue the adjudication act even if the successful bidder has already paid the full price. The ruling is binding under Article 521(3) of the Code. The referral arose from a civil enforcement dispute in which the question was whether payment after the auction sale but before the adjudication act could still halt the enforcement and prevent the transfer of title to the bidder.
