The High Court of Cassation and Justice, sitting as the Panel for Resolving Questions of Law, rejected as inadmissible a preliminary reference submitted by the Bucharest Court of Appeal regarding the tax treatment of specific employee benefits. The dispute concerned whether reimbursements for medical assistance, medicines, and prostheses, granted pursuant to Article 67(1) of Law No. 567/2004, qualify for exemption from income tax and social security contributions under Articles 56(4)(a), 76(4)(f), 142(e), and 157(2) of the Fiscal Code. The court did not resolve the substantive legal question but dismissed the referral on procedural grounds, ordering that the proceedings be handled in accordance with Article 521(3) of the Code of Civil Procedure, thereby leaving the original jurisdiction to address the case without the requested interpretive guidance.
