The High Court of Cassation and Justice dismissed as inadmissible the request for a preliminary ruling submitted by a civil tribunal, thereby leaving the lower court's proceedings to continue without a binding resolution from the supreme jurisdiction. The dispute concerned the calculation of salary rights for IT specialists employed at courts of appeal, specifically whether the pension length coefficient should be calculated based on the effective total length of service in the specialty, as defined in the Note to Chapter II of Annex No. V to Law-No. 153/2017, following the suspension of the legal applicability of that Annex. The case centers on the principles of equality and non-discrimination under Article 6(1) of Law-No. 153/2017 regarding public sector remuneration, with the decisive procedural basis being the inadmissibility of the preliminary reference under Article 521(3) of the Civil Procedure Code.
