The Supreme Court of Romania rejected as inadmissible the consolidated referrals submitted by the Neamts District Court, thereby upholding the procedural immunity of the original labor litigation without resolving the substantive legal questions. The dispute arose from a request to clarify whether the binding legal interpretations issued under Article 521(3) of the Code of Civil Procedure extend exclusively to pending judicial proceedings or also apply to ongoing labor relationships, and whether such interpretations prospectively suspend salary rights previously recognized by a final judgment. The decisive legal basis for the dismissal was the procedural inadmissibility of the referrals, preventing the court from expanding the scope of mandatory legal clarifications beyond strictly pending judicial cases or altering the status of already finalized salary entitlements.
