The High Court of Cassation and Justice dismissed as inadmissible the preliminary reference submitted by the Bucharest District Court regarding a labor dispute, leaving the lower court to proceed without a definitive ruling from the supreme court on the specific legal question. The case centered on whether a military prosecutor was unlawfully discriminated against within the judicial corps by the automatic redirection of a 25% social security contribution from their gross monthly income to the state budget under the Military State Pensions Law, which allegedly deprived them of the right to choose between a service pension in the "Justice" occupational system, a contribution-based pension, or private pension fund contributions. The decisive procedural basis for the dismissal was Article 521(3) of the Civil Procedure Code, which rendered the request for a preliminary ruling on this interpretation of pension and social insurance statutes inadmissible.
