The High Court of Cassation and Justice admitted the appeal in the interest of the law filed by the Court of Appeal Board of Brașov, issuing a mandatory binding interpretation regarding military entitlements. The dispute concerned whether personnel on individual missions abroad during the period from June 20, 2011, to January 27, 2020, were entitled to foreign currency daily allowances based on Government Decision no. 1.086/2004. In its operative decision, the Court ruled that the foreign currency daily allowance under the aforementioned Government Decision is not granted to military personnel on such individual missions, as they are distinct from the peace missions and operations defined in the relevant statute. This determination established the unified interpretation of Law no. 121/2011 on the participation of armed forces in missions abroad, specifically Article 7(3) and Article 2(1)(c), in conjunction with the abrogated Government Decision no. 1.086/2004, effectively denying the financial benefit for that specific category of personnel for the designated timeframe.
