The High Court of Cassation and Justice dismissed as inadmissible the reference for the resolution of a legal question submitted by the Court of Appeal, thereby leaving the lower court's proceedings unaffected and denying the initiating court's request for a binding interpretation. The dispute concerned whether civil courts possess the authority to independently verify the substantive accuracy of an employer's certification characterizing an employee's work as falling within specific categories eligible for retirement benefits, rather than relying solely on the document's form. The decisive legal basis involved the interpretation of Article 30(1)(i) and (44) of Law No. 263/2010 regarding the public pension system, specifically addressing the limits of judicial review over employer-issued activity certifications in pension eligibility cases.
