The High Court of Cassation and Justice dismissed as inadmissible the reference for the resolution of a legal issue submitted by the Brașov Court of Appeal, leaving the lower court to resolve the merits of the underlying labor dispute. The case concerned whether a public sector employee on assignment was entitled to a daily food allowance for the entire period of assignment, notwithstanding that they had already received the equivalent of a per diem allowance. The decisive legal basis involved the interpretation of Articles 18(1) and (2) of the Framework Law No. 153/2017 regarding the remuneration of personnel paid from public funds, specifically regarding the exclusivity or compatibility of specific allowances during periods of temporary assignment.
