The High Court of Cassation and Justice dismissed as inadmissible the preliminary reference submitted by the Sibiu County Court, leaving the lower court to resolve the matter without a binding supreme court ruling on the legal issue. The dispute concerned the calculation methodology for a 15% surcharge for working conditions granted to budgetary personnel in the "Culture" occupational family, specifically whether the surcharge was calculated based on the salary level in December 2018 or adjusted according to subsequent changes in the base salary under the Framework Law on Public Sector Remuneration. The case involved a challenge to the interpretation of Government Decision No. 360/2018 and Article 39 of Framework Law No. 153/2017, with the court’s procedural decision relying on Article 521(3) of the Civil Procedure Code, which mandates that such decisions are obligatory and final regarding admissibility.
